All intellectual property rights in and to the AIStorm products, services, software, documentation, upgrades, and any derivative works-including but not limited to copyrights, patents, trade secrets, and trademarks-are and shall remain the exclusive property of ASIAINFO SECURITY Technology PTE. LTD or its licensors. This Legal Notice and the associated User License Agreement grant you only a limited, non-exclusive, non-transferable, and non-sublicensable license to use the Services for your internal business purposes, subject to the terms and conditions set forth therein.

3. No Warranty and Limitation of Liability

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ASIAINFO SECURITY TECHNOLOGY PTE. LTD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT THEY WILL DETECT ALL MALICIOUS CONTENT OR THREATS.

IN NO EVENT SHALL ASIAINFO SECURITY TECHNOLOGY PTE. LTD, ITS AFFILIATES, SUPPLIERS, OR CHANNEL PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THIS LEGAL NOTICE OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT.

4. Governing Law and Dispute Resolution

This Legal Notice shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law principles, except where mandatory provisions of the laws of the applicable regions prevail.

Any dispute, controversy, or claim arising out of or in connection with this Legal Notice shall be finally settled by arbitration in Beijing in accordance with the then-effective arbitration rules of the Beijing Arbitration Commission. The arbitral award shall be final and binding upon both parties. The language of the arbitration shall be Chinese.
